The Impact of the Constitutional Court's Decision

Abstract

It has been half a century since the development trends of the countries have been determined by the scope of implementation of the Constitutionalism. The implementation of the constitutionalism, as well as the democratic political system, requires many factors, causes and conditions, such as social stability, unity diversity, social awareness and legal culture. Of these, constitutional regulation mechanism is the most important for the implementation of constitutionalism principles. The constitutional regulation mechanism (system) is a factor limiting the unrestricted authority of the state and a unique medium that stops attempts to violate constitutionalism legal principles. The purpose of this study is to article and analyze the role of the Constitutional Court in strengthening constitutionalism, based on the legal theory and principles of the Constitution and constitutional process, on the ground of international comparative legal research, to determine future trends, to improve the legal environment related to the consequences of the Constitutional Court’s decision and its implementation, and to study and develop the methodology of the interpretation of the Constitution and the methodology of constitutional law application.

Үндсэн хуульт ёсны хэрэгжилт хэр байгаагаас улс орнуудын хөгжлийн чиг хандлагыг тодорхойлох болсоор багагүй хугацааг үдэж байна. Үндсэн хуульт ёсны хэрэгжилт, мөн улс төрийн адчилсан тогтолцоо нь нийгмийн тогтвортой байдал, нэгдмэл болон олон талт шинж, нийгмийн ухамсар ба эрх зүйн соёл зэрэг олон хүчин зүйл, шалтгаан, нөхцөлийг шаарддагийн дотор Үндсэн хуульт ёсны зарчмын хэрэгжилтэд тулгуур ач холбогдолтой нь Үндсэн хуулийн хяналтын механизм юм. Үндсэн хуулийн хяналтын механизм (тогтолцоо) нь төрийн хэмжээлшгүй эрх мэдлийг хязгаарлах хүчин зүйл бөгөөд Үндсэн хуульт ёсны болон хууль ёсны зарчмыг зөрчих оролдлогыг таслан зогсоодог өвөрмөц хэрэгсэл юм. Үндсэн хуульт ёсны үндсэн баталгаа болох Үндсэн хуулийн цэцийн маргаан хянан шийдвэрлэх үйл ажиллагааг боловсронгуй болгон гарч буй шийдвэрийн үндэслэлийг сайжруулах, гаргаж буй шийдвэрээрээ Үндсэн хуулийг тайлбарлах, Үндсэн хуулийн хэрэгжилтийг хангуулах эрх хэмжээг өргөтгөх зэрэг нэн даруй шийдвэрлэх асуудлууд оршсоор байна.
