The Use of Personal Light Electric Vehicles: Legal Regulation /On the Example of Electric Bicycles and Scooters/

Abstract

In Mongolia, the introduction and increasing use of electric bicycles (hereinafter referred to as “Surron”) and electric scooters, in road traffic have led to a growing risk of traffic accidents. This trend has resulted in various issues, including potential harm to individuals’ health and property, as well as adverse impacts on citizens’ right to safe mobility.

In this context, it is necessary to examine the existing legal framework governing electric bicycles and scooters, identify the challenges currently faced, and determine the need for legal regulations to address these issues. Furthermore, there is a need for a comprehensive analysis of how such regulations can be aligned with the current socio-economic conditions, population lifestyle, settlement patterns, and infrastructure development.

Additionally, it is essential to conduct a comparative study of legal regulations concerning personal light electric vehicles in foreign countries and to adopt best practices. Therefore, this article addresses the issue of clarifying the legal framework related to newly introduced types of personal light electric vehicles in Mongolia, including electric bicycles and scooters, and aims to determine whether state regulation of their use is necessary.

Монгол Улсад цахилгаан дугуй (Цаашид цахилгаан дугуй гэж зөвхөн “Суррон”-ыг ойлгоно.), скүүтер замын хөдөлгөөнд оролцож эхэлснээр иргэд зам тээврийн осолд өртөх магадлал ихсэж, өөрт болон бусдад эрүүл мэнд, эд хөрөнгийн хохирол учруулах, иргэдийн аюулгүй зорчих эрхэд нөлөөлөх зэрэг асуудлыг бий болгож байна. Үүнтэй холбоотойгоор цахилгаан дугуй, скүүтерийн талаарх одоогийн эрх зүйн орчныг судалж, тулгамдаж буй асуудлыг илрүүлэх, түүнийг шийдвэрлэх эрх зүйн зохицуулалтын хэрэгцээ, шаардлагыг тодорхойлох, нийгэм, эдийн засгийн өнөөгийн байдал, хүн амын амьдралын хэв маяг, суурьшил, дэд бүтцийн хангамжтай хэрхэн уялдах талаар нарийвчлан судлах шаардлагатай байна. Түүнчлэн бичил цахилгаан тээврийн хэрэгсэлтэй холбоотой гадаад улс орнуудын эрх зүйн зохицуулалтыг харьцуулан судалж, тэдгээрээс сайн жишгийг нэвтрүүлэх шаардлага үүссэн. Тиймээс манай улсад нэвтэрсэн шинэ төрлийн бичил цахилгаан тээврийн хэрэгсэл, түүний дотор цахилгаан дугуй, скүүтертэй холбоотой эрх зүйн орчныг тодорхой болгох тухай асуудлыг энэхүү өгүүллээр хөндсөн бөгөөд цахилгаан дугуй, скүүтерийн хэрэглээнд төрөөс зохицуулалт хийх шаардлагатай эсэхэд хариулт өгөхийг зорьсон болно.
