The Characteristics, Lessons, and Historical Significance of Mongolia's First (1924) Constitution

Abstract

This article examines the content, significance, and historical lessons of the 1924 Constitution of the Mongolian People’s Republic - Mongolia’s first constitution. The author argues that this constitution held the significance of establishing the constitutional-legal foundations for Mongolia to become an independent and fully sovereign state, as well as for granting its citizens certain defined rights and freedoms. The author also emphasizes that this constitution left a deep and lasting imprint on Mongolia’s development through its historical lessons: excessive subjection to the influence of a single country, the decimation of Mongolia’s intellectual elite, the suppression of pluralism, and the denial of private property.

Монгол Улсын анхдугаар (1924 оны) Үндсэн хуулийн онцлог, сургамж, түүхэн ач холбогдол

Энэхүү өгүүлэлд БНМАУ-ын 1924 оны буюу анхдугаар Үндсэн хуулийн агуулга, ач холбогдол, түүхэн сургамжийн тухай хөнджээ. Эл Үндсэн хууль нь тус улсыг тусгаар тогтносон, бүрэн эрхт улс болох, түүнчлэн ард иргэдэд зарим тодорхой эрх, эрх чөлөө эдлүүлэх Үндсэн хуулийн эрх зүйн үндсийг тавьсан ач холбогдлыг агуулсан гэж зохиогч үзжээ. Нэг улсын нөлөөнд хэт орсон, Монголын нийгмийн оюунлаг (элит) хэсгийг хүйс тэмтэрсэн, олон ургальч үзлийг хаан боогдуулсан, хувийн өмчийг үгүйсгэсэн зэрэг байдлаар энэ Үндсэн хууль Монгол орны хөгжилд гүн гүнзгий ул мөрөө үлдээсэн түүхэн сургамжтай болохыг онцлон тэмдэглэжээ.
